You are in dire need of a primer on what does and does not constitute Fair Use before you go dropping multi-paragraph lectures on the topic in other people's LJs. Fair use covers "criticism, comment, news reporting, teaching (including multiple copies for classroom use), scholarship, or research" and this post fulfills four or perhaps five of those criteria under even the broadest definitions and it is broad definitions which apply.
If you consider this a "serious matter" then you might try doing the serious reading to go along with it. Googling "Understanding Fair Use" would be a good start.
